§ 1

Scope of Application

These Terms and Conditions ("Terms") govern the use of the platform Bazaar ("Platform"), operated by Bazaar Analytics Inc. ("we", "us", "our"). By registering for and/or using the Platform, you ("User", "you") acknowledge and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and paying subscribers. Supplementary or deviating conditions of the User shall not apply unless expressly agreed to in writing by us.

§ 3

Service Description & Intermediary Status

Bazaar is a professional software platform for watch dealers. The Platform provides:

  • Structured, searchable listing data sourced from dealer WhatsApp groups
  • Advanced search and filter functions
  • Market analysis, price trends, and analytics
  • Outreach and notification tools

IMPORTANT: Intermediary Status

Bazaar is exclusively a software and information service provider. We do not sell watches and are not a party to any purchase agreement between users. All listing data displayed on the Platform originates from third-party dealer sources and is collected and structured automatically. We do not guarantee the accuracy, availability, or authenticity of any listing. Any transaction between users is the sole responsibility of the parties involved.

§ 4

Registration & User Account

Use of the Platform requires registration. You agree to provide truthful and complete information during registration. Account activation may be subject to review and approval by our team. We reserve the right to reject registrations without providing a reason.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Each individual user may only maintain one personal login. Organizations may add multiple team members under a single organization account in accordance with their subscription tier. Creating duplicate personal logins to circumvent seat limits or other restrictions is prohibited and may result in immediate termination.

§ 5

Terms of Use

You agree to:

  • Use the Platform only for lawful purposes
  • Not share, redistribute, or publicly disclose data obtained through the Platform outside your organization
  • Not use the Platform for unauthorized commercial purposes
  • Not perform automated queries, scraping, crawling, or data extraction of any kind
  • Not reverse-engineer, decompile, or attempt to derive the source code of the Platform
  • Not infringe on copyrights, trademarks, or other intellectual property rights
  • Not overload, disrupt, or interfere with the Platform's operation or infrastructure
  • Not use the Platform to facilitate fraud, money laundering, or other illegal activities

Violation of these terms may result in immediate account suspension or termination, and we reserve the right to pursue legal action where appropriate.

§ 6

Subscription & Payment

The Platform offers paid subscription tiers for dealer organizations. Subscriptions provide access to features including search, analytics, outreach, and notification tools.

Payment Processing

Subscriptions are processed through Stripe. Payment methods may include credit card and other methods supported by Stripe.

Subscription fees are due in advance for the selected billing period (monthly). Subscriptions renew automatically unless cancelled before the end of the current billing period.

§ 7

Refund Policy

Subscriptions are billed in advance on a monthly basis. Because Bazaar is a business-to-business service, statutory consumer withdrawal rights (such as those applicable to EU consumers) do not apply; the following commercial refund policy governs instead.

  • Free trial: if you cancel before your free trial period ends, you will not be charged.
  • First billing cycle: new subscribers may request a full refund within 14 days of their first payment, provided the account has not been used to conduct a material volume of searches, outreach, or serial checks.
  • Subsequent billing cycles: subscription fees are non-refundable once a billing period has begun, except where required by law. You may cancel at any time to stop future renewals; your access continues until the end of the current paid period.
  • No refund will be issued in the event of a violation of these Terms resulting in account suspension or termination.

To request a refund, contact us at contact@bzaar.ca with your account details and the reason for your request. We aim to process eligible refund requests within 5–7 business days.

§ 8

Data Protection & Anonymity

The Platform structures listing data collected from dealer WhatsApp groups into searchable, aggregated market data. Where analytics or market-trend outputs are described as anonymized or aggregated, underlying identifying details are not exposed in that output.

§ 9

Automated System & Data Quality

Automated Data Collection

All listing data is collected and structured automatically using AI-powered systems. No manual review or validation of data is performed by our staff. The systems operate continuously and collect new listings from third-party sources.

Data Quality & Accuracy

  • All displayed data may be inaccurate, incomplete, or outdated
  • Prices, availability, and specifications are not guaranteed
  • Listings may already be sold or no longer available
  • No warranty for authenticity or condition of watches

Users are obligated to verify all information directly with the counterparty before making any purchase. Bazaar assumes no responsibility for the quality, authenticity, or availability of displayed listings.

§ 10

Liability Disclaimer

Bazaar Analytics Inc. assumes no liability for the accuracy, completeness, or timeliness of the information provided on the Platform. Use of the Platform is at your own risk.

  • No liability for incorrect, incomplete, or outdated data
  • No liability for purchasing decisions based on our information
  • No liability for losses due to unavailable or erroneous listings
  • No liability for damages caused by third-party dealers or their products
  • No liability for technical outages, service interruptions, or data loss
  • No liability for damages arising from unauthorized access to user accounts

To the maximum extent permitted by applicable law, in no event shall Bazaar Analytics Inc., its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages.

§ 11

Copyright & Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, software, and database compilations, is the property of Bazaar Analytics Inc. or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

Reproduction, distribution, modification, or commercial use of Platform content without express written permission is strictly prohibited.

§ 12

Termination

Either party may terminate the user account at any time. You may delete your account through account settings or by contacting us at contact@bzaar.ca.

We reserve the right to suspend or terminate your account immediately without prior notice if you violate these Terms, engage in fraudulent or illegal activity, or if we reasonably believe your use of the Platform may harm other users or the Platform itself.

§ 13

Amendments to Terms

Bazaar Analytics Inc. reserves the right to modify these Terms at any time. Changes will be communicated to users via email and/or a notice on the Platform. Continued use of the Platform after notification constitutes acceptance of the modified Terms.

§ 14

Final Provisions

Severability Should any provision of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Governing Law These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Jurisdiction The courts of Ontario, Canada shall have exclusive jurisdiction over any disputes arising from these Terms.

Entire Agreement These Terms, together with our Privacy Policy and any supplementary agreements, constitute the entire agreement between you and Bazaar Analytics Inc. regarding use of the Platform.
